Child Custody Advice for the Recently Divorced

Getting the answer for every question of a child and providing them with the proper life is one of the hardest tasks for both divorced couples. Both the custodial and non-custodial parent should consider the below mentioned advice which can guide them through their job.

Advice for the Parent who is having child custody:

The custody of a child in case of a divorce is determined by the court, they give the custody considering the well being of the child. If one of the spouse gains the sole custody of the child then it is their responsibility to make sure that the child is getting the best possible education and health care. The parent having the sole custody is responsible to take major decisions for the child whether it is related to religion to follow or the welfare program.

In some case the couple agrees to go for divorce but decide to give a completely normal life to their children. In such a case they apply for shared custody so that both the parents get to spend equal time with children.

The most important thing that should be understood by both the party’s is that the child should never be dragged to the court as it has a bad effect on their mental state and may get them into developing a thinking that compels them to believe that they are the main culprit of the divorce.

Advise for the non-custodial parent:

The main thing to which the non custodial parent should get adapted to is that they don’t have the right equivalent to the custodial one. But then this does not say that non-custodial parent has no rights to be with their kids. Following are some of the rights that are with the non-custodial parent:

  • The court decides the specific days and duration for which the kids get to spend some quality time with the parent.
  • The court also decides the type of contact the child can have with the non-custodial parent.
  • It is the right of the court to decide the child support that will be offered by the parent with no custody, and decision is done keeping in mind the income of both custodial and non-custodial parent.
  • A clarified child custody agreement is provided by the court which define the right of each parent whether it be access to the child’s school or medical records.

During a legal proceeding it is the job of the parents to preserve their child from such kind of stressful environment and provide them with normal, stable and friendly surroundings after the divorce has been finalized.
